current Maoist Constituent Assembly Member Bal Krishna Dhungel in Ujjan Kumar
Shrestha's murder. The prime minister
was then reported to have sought Presidential pardon for Mr. Dhungel. The
Maoist CA Member is now enjoying 'constitutional immunity' as the
house has not adjourned yet. The Prime Minister rides 'Mustang thing' but does
not hesitate to grant 20 million rupees separately each: to a Dalit team and a team of the son of Maoist Chairman Prachanda to climb Mt. Sagaramatha ! What an enlightening thought! Who would buy such a populist stuff from a prime minister of some academic excellence? In the meantime likewise, it seems in Nepal, people can do any thing they liked whatever. They can go to the streets against the government while the party
president is a sitting Minister for Civil Works and Transportation. Again, the minister's party, the Rashtriya Janamukti Party (राष्ट्रिय जनमुक्ति पार्टी )- is now reported to have warned to send those to the gallows who would go against federalism. Can a political party do such things ? Likewise down the road, the NEFIN, a complete social organization in Kathmandu has announced that it would close Nepal down for three days: May 14, 15 and 16 so as to pressurize the government to promulgate a federal constitution. But the government had in 2010 invited a a Hindu Yoga Guru to run yoga-camps in Nepal few weeks before the deadline. Few days ago again few weeks before the deadline, in Kathmandu there were a number of BJP leaders who warned that Nepal can't become a 'junction of terrorist organizations' - seemingly the hint was also made against an international seminar organized in Dharan January 19-21, 2012, in which some IP leaders from North Eastern India had also taken part. The southern Nepalese neighbour, India seems to be thinking those Indian IP leaders as 'terrorists' or 'separatists' - so to speak. The Hindu Yoga Guru and BJP are synonymous to Hindu system of governance or the 'Manu Government' (मनुवादी सरकार)' with Kamandak (कामन्दक) directives. This should also mean they stand against proposed secularism in Nepal. They might also want the ousted King back on the throne again. Can Nepal carry any such pressure from Delhi Durbar ? - Editor]

Their concern comes four days after political parties reached a deal to form a single panel to carry out the function of both Truth and Reconciliation Commission and Commission on the Disappeared.
“Negotiations are under way among key Nepali political leaders to grant a broad amnesty in connection with creating transitional justice commissions to address abuses committed during the civil war. The proposed amnesty would extend to crimes under international laws, including war crimes,” International Commission of Jurists and Human Rights Watch said in a joint press statement.
The two organisations said political leaders have proposed amendments to the pending Bill in the Parliament that would empower the commission to grant amnesty to leaders and members of both government forces and armed groups for acts that would amount to serious violations of international human rights or humanitarian instruments.
“Amnesty for gross human rights abuses such as torture, rape, and enforced disappearance violates international laws,” the press statement quotes Frederick Rawski, country representative for the ICJ as saying.
“The victims have the right to know what happened and to seek effective remedy and reparation, including the prosecution of those responsible,” the release quotes John Sifton, Asia advocacy director at the HRW.
Experience from other post-conflict settings suggests that providing amnesty for the most serious crimes of the recent past will further entrench a culture of impunity in Nepal, say the groups.
“Providing amnesty for the most serious crimes is against the government of Nepal’s obligations to prosecute and punish crimes under international law, such as torture and enforced disappearance, and war crimes such as unlawful killings carried out during the armed conflict,” reads the joint statement from the rights organisations.
According to the rights organisations, the term ‘political consensus’ for the appointment of members of the proposed commission appear to allow appointments to the panel based on political ideologies, undermining the commission’s independence.
The organisations expressed support for Nepali civil society activists, lawyers, journalists, victims of rights violations and their families, who have spoken out against attempts to politicise the proposed commissions.
अपराधीलाई उन्मुक्ति नदिने प्रधानमन्त्रीको निर्देशन: अर्को 'शब्द पाखण्ड' वा 'ढाँटको निम्तो’?
राजनीतिक आवरणमा अपराध गर्नेलाई उन्मुक्ति नदिन प्रधानमन्त्री बाबुराम भट्टराईले नेपाल प्रहरीका महानिरीक्षकलाई शनिबार निर्देशन दिएका छन्। प्रधानमन्त्रीका सहयोगीलाई उद्धृत गर्दै प्रकाशित समाचारअनुसार उनले प्रहरी महानिरीक्षकलाई निर्देशन दिनुभन्दा पहिले सत्ता साझेदार मधेसी मोर्चालगायत प्रमुख राजनीतिक दलका नेताहरूसँग अपराधीलाई राजनीतिक संरक्षण नदिने विषयमा सल्लाहसमेत गरेका थिए। प्रधानमन्त्रीको यस प्रयासलाई सबै दलका नेताले समर्थन गरेका छन्। प्रधानमन्त्रीका ती सहयोगीका अनुसार राजनीतिकर्मी र दलहरूले अपराधीलाई संरक्षण गरेकोमा धेरै उजुरी आएका छन्। कतिपय मामिलामा त शीर्ष नेताहरूले नै सुरक्षाकर्मीहरूमाथि अपराधीलाई कारबाही नगर्न दबाब दिएका थिए। प्रधानमन्त्रीले बोलाएरै अपराधीलाई उन्मुक्ति नदिन निर्देशन दिएपछि प्रहरी महानिरीक्षकको मनोबल उच्च भएको हुनुपर्छ।
संविधानसभाभित्रै पनि अपराधमा मुछिएकाको संख्या निकै ठुलो छ। तीमध्ये कर्तव्य ज्यानमा सर्वस्वसहित जन्मकैदको सजाय पाएका व्यक्तिदेखि जालसाजी र आफ्नो सट्टा अर्को व्यक्तिलाई परीक्षा दिन पठाउनेहरूसम्म छन्। अरू मुलुकमा भए त्यस्ता व्यक्ति संसद्मा नभएर ‰यालखानामा हुन्थे। यस्तै, प्रहरीले विभिन्न अपराधको अभियोगमा खोजतलास गरिरहेको व्यक्ति गृह मन्त्री र प्रहरीका उच्च अधिकारीहरूसँगै सार्वजनिक समारोहमा देखिन्छन्। विधिको शासन र राजनीतिक नैतिकताको मूल्य भएको मुलुकमा हुन्थ्यो भने अभियुक्तसँग हातेमालो गर्ने राजनीतिक पदाधिकारी र प्रहरी अधिकृत तस्बिर सार्वजनिक हुनेबित्तिकै निलम्बित हुन्थे। नेपालको कानुनअनुसार पनि अपराधीलाई लुकाउन वा सजायबाट जोगाउन खोजे सरकारवादी फौज्दारी मुद्दा लाग्छ। तर, राजनीतिक शक्तिको दुरुपयोग गरेर अपराधीलाई दण्डबाट उन्मुक्ति दिइँदै आइएको छ। यस्तो अवस्थामा प्रधानमन्त्री भट्टराईले साँच्चै नै राजनीतिक आवरणमा हुने अपराधलाई उन्मुक्ति नदिन निर्देशन दिएका हुन् भने उनको सराहना गर्नैपर्छ।
व्यवहारमा देखा नपरुन्जेल चाहिँ प्रधानमन्त्री भट्टराईले राजनीतिक आवरणमा हुने अपराधलाई कानुनको घेरामा ल्याउन निर्देशन दिए भन्ने समाचार पत्याउन गाह्रै हुन्छ। राजनीतिक संरक्षण पाउने अधिकांश अपराधी र अभियुक्त प्रधानमन्त्री भट्टराईको पार्टी एनेकपा (माओवादी) सम्बद्ध छन्। उनको सत्ता साझेदार संयुक्त लोकतान्त्रिक मधेसी मोर्चामा संलग्न राजनीतिक दलमा पनि त्यस्ता व्यक्तिको संख्या ठुलै छ। उनीहरूका तुलनामा राजनीतिक संरक्षण पाउने अपराधी नेपाली कांग्रेस र नेकपा (एमाले) वा अरू दलमा अपेक्षाकृत कमै छन्। यसैले प्रधानमन्त्री भट्टराई साँच्चै नै दण्डहीनता अन्त्य गर्न चाहन्छन् भने पहिले आफ्ना पार्टीभित्रका अपराधीलाई कानुनको जिम्मा लगाउन तत्पर हुनुपर्छ। सत्ताको मोह त्यागेर पनि मधेसी मोर्चाका नेताहरूले संरक्षण गरेका अपराधीलाई सजाय गराउन अग्रसर हुनुपर्छ। प्रहरीलगायत राज्यका कानुन कार्यान्वयन निकायमा हस्तक्षेप तत्काल बन्द गर्नुपर्छ। सरकारी पदाधिकारीहरूले प्रहरीको कामकाजमा हस्तक्षेप नगर्ने हो भने अरू दलका नेतालाई अवैध र अनुचित काममा दबाब दिने आँटै आउनेछैन।
कर्तव्य ज्यानमा सजाय पाएका व्यक्तिलाई संरक्षण गर्ने, मानवताविरुद्धका जघन्य अपराधका मुद्दा फिर्ता लिने निर्णय गर्ने र राजनीतिक आवरणमा भएका अपराधमा एकमुष्ठ माफी दिलाउने प्रयास गर्ने प्रधानमन्त्री भट्टराई 'रत्नाकरबाट बाल्कीमि' भएकै हुन् भने मुलुकका लागि ठुलै खुसीको विषय हो। नत्र, यो उनको अर्को 'शब्द पाखण्ड' सिद्ध हुनेछ। 'ढाँटको निम्तो खाई पत्याउनु' भन्छन्। हेरौँ! केही दिनमै मुलुक दण्डहीनताको अन्त्यतर्फ उन्मुख भई पो हाल्छ कि?
मन्त्रीकै पार्टीद्वारा संघीयताविरोधीलाई फाँसी दिने चेतावनी !
काठमाडौं, वैशाख १२ - राष्ट्रिय जनमुक्ति पार्टीले संघीयताविरोधीहरुलाई फाँसी दिने चेतावनी दिएको छ ।
जनमुक्ति पार्टी राष्ट्रिय जनमोर्चाका अध्यक्ष चित्रबहादुर केसी र राप्रपा नेपालका अध्यक्ष कमल थापालगायत संघीयताविरोधीहरुलाई फाँसी दिने चेतावनी दिएको हो । सो पार्टीका अध्यक्ष एमएस थापा वर्तमान बाबुराम भट्टराई सरकारमा श्रम तथा यातायात व्यवस्था मन्त्री छन् ।
सोमबार रिपोर्टर्स क्लब नेपालमा पत्रकार सम्मेलन गर्दै राष्ट्रिय जनमुक्ति पार्टीले दोस्रो चरणको आन्दोलनमा संघीयताविरोधीहरुको प्रतीकात्मक आकृति (पुत्ला) लाई कोणसभासहित सार्वजनिकस्थलमा जेठ १ गते ३ बजे फाँसी दिने कार्यक्रम तय गरेको हो ।
पत्रकार सम्मेलनमा जेठ १४ मै जातिय पहिचानसहितको संविधान जारी गराउन, संघीयता विरोधीहरुको अवाञ्छित गतिविधि निस्तेज पार्न र निर्धारित समयमै संविधान जारी नभएमा व्यापक रुपमा नजआन्दोलनको पूर्व तयारी गर्न दोस्रो चरणको आन्दोलनको घोषणा गरेको छ ।
आन्दोलन परिचालन समितिका संयोजक केपी पालुङ्वाले दोस्रो चरणको आन्दोलनबाट पनि संघीयतासहितको संविधान बनाइएन भने तेस्रो चरणको आन्दोलनबाट संघीयताविरोधीहरुलाई फाँसी दिनेसम्मको कार्यक्रम ल्याउन बाध्य हुने चेतावनी दिए ।
उनले भने– ‘नेपालको कानुन दैवले जानुनको अवस्थामा रहेको छ, जेठ १४ भित्र संघीयतासहितको जनताको संविधान जारी भएन भने राष्ट्रिय जनमुक्ति पार्टी संघीयता विरोधीहरुलाई फाँसी दिने अभियानमा लाग्ने छ ।’
जानजाति महासंघद्धारा तीन दिने नेपाल बन्दको घोषणा

मंगलबार आहृवान गरिएको तराई बन्द नसकिँदै नेपाल आदिवासी जनजाति महासंघले तीन दिने नेपाल बन्दको घोषणा गरेको छ ।
बन्दमा दमन भएको तथा आदिवासी जनजातिको मागलाई बेवास्ता गर्दै संविधान बनाउने प्रयास भएको भन्दै महासंघले जेठ १, २ र ३ गते नेपाल बन्दको घोषणा गरेको हो । यस्तै उसले जेठ ५, ६ र ७ गते राष्ट्रिय राजनीतिक सम्मेलन बोलाएको छ । आन्दोलनका थप कार्यक्रम घोषणा गर्न महासंघले साँझ ५ बजे पत्रकार सम्मेलन गर्दैछ ।
महासंघका अध्यक्ष राजकुमार लेखीले आदिवासी जनजातिको मागलाई बेवास्ता गर्दै संविधानको मस्यौदा ल्याउने र जेठ १४ गते संकटकाल लगाएर संविधानसभाको म्याद थप्ने षड्यन्त्र भइरहेकाले दबावमुलक आन्दोलन घोषणा गर्न लागिएको बताउनु भयो । महासंघल्ले संविधानसभाको राज्य पुनःसंरचना समितिले तयार पारेको पहिचानसहितको १४ प्रदेश हुनु पर्ने माग गर्दै आएको छ ।
जनजाति महासंघले मंगलबारको तराई बन्दका क्रममा घाइतेको उपचार गर्न तथा पक्राउ गरिएकाहरुलाई बिना सर्त अविलम्ब रिहा गर्न समेत सरकारसँग माग गरेको छ । बन्दका क्रममा ४७ जना नेता कार्यकर्ता पक्राउ गरेको महासंघले बताएको छ ।
